Its 1st Battalion was assigned to the 168th (London) Infantry Brigade, 56th (London) Infantry Division, and was deployed to Italy, where it took part in the battles of Monte Cassino and Anzio.
As for its 3rd Battalion, it was decided that it would become an anti-aircraft unit of the Royal Artillery. In 1939, it was renamed the 97th (The London Scottish) Heavy Anti-Aircraft Regiment, RA, and was assigned to the 1st Anti-Aircraft Division. It participated in the defense of London during the Battle of Britain. In 1943, it was transferred to the British Eighth Army and deployed to Sicily and Italy until the end of 1944.

The Code provides additional penalties, including the confiscation of the items used or intended for committing the offence.
